25 May Can You Travel Overseas While Under Debt Review
If you are under debt review and have travel plans on the horizon, whether for work, a family visit, or a long-overdue holiday, you are probably wondering whether the process places any restrictions on leaving the country. It is one of the more common questions people have, and the answer is more straightforward than most people expect.
The Short Answer: Yes, You Can Travel
Being under debt review does not prevent you from travelling overseas. There is nothing in the National Credit Act or in the debt review process itself that restricts your movement or prohibits you from holding or using a passport. You are not flagged at border control, and your debt review status does not appear on any immigration or travel system.
Debt review is a credit and financial arrangement between you, your debt counsellor, and your creditors. It has no bearing on your rights as a South African citizen to travel freely.
That said, there are a few practical and financial considerations worth thinking through carefully before you book anything.
Your Passport Cannot Be Taken Away
Some people worry that creditors or the courts can confiscate their passport as part of the debt review process. This is not the case. Passport confiscation in South Africa is reserved for very specific criminal and legal proceedings, and debt review is neither of those things.
Debt review is a voluntary, protective process that you apply for. It is designed to help you, not punish you. Your debt counsellor has no authority over your travel, and creditors cannot instruct you to surrender your passport.
The only scenario in which travel could be legally complicated is if a creditor had obtained a civil judgement against you before your debt review began and had taken further steps through the courts. Even then, passport restriction is extremely rare in civil debt matters. If you have any concerns about your specific situation, it is worth speaking to your debt counsellor directly.

The Real Concern: Your Monthly Payment
While there is no legal barrier to travelling, the more important question is a financial one. Under debt review, you are committed to making a fixed monthly payment to a Payment Distribution Agency, which then distributes funds to your creditors. Missing or delaying this payment, for any reason, including being overseas, has serious consequences.
If you miss a payment, your creditors are legally entitled to withdraw from the debt review agreement and resume legal action against you. One missed payment can undo the protection that the entire process provides.
Before travelling, make sure of the following:
- Your monthly debt review payment is set up as an automatic debit order that will run as normal while you are away. Do not rely on remembering to make a manual transfer from abroad.
- Your bank account has sufficient funds to cover the payment for the full duration of your trip, plus a buffer for any unexpected delays.
- You have notified your debt counsellor of your travel plans, particularly if you will be away for an extended period. This is not a legal requirement, but it is good practice and ensures there is no confusion if something needs to be communicated while you are gone.
If You Are Travelling for Work
Many people under debt review continue to travel internationally for professional reasons. There is absolutely no conflict here. Your employer does not need to know about your debt review status, and it will not appear on any background check that is not specifically a credit check.
If your employer runs credit checks as part of their HR process, your debt review status may be visible, but this is a separate matter from travel itself and is worth understanding in the context of your specific employment contract. The benefits of debt counselling generally far outweigh the discomfort of having that conversation if it ever arises.
