Prescribed Debt: Can Old Debt Be Written Off?

Yes, under certain conditions, old debt in South Africa really can become legally unenforceable. This is called “prescribed debt,” and it means a creditor has lost the legal right to collect on it. It sounds almost too good to be true, so it is worth understanding exactly how prescription works, how to check whether it applies to you, and the one mistake that can undo it all.

What Is Prescribed Debt?

Under the Prescription Act, most consumer debt becomes prescribed after three years if your creditor has not taken any action to collect it and you have not acknowledged or paid anything toward it during that time. Some debts take much longer to prescribe. Mortgage bonds, judgment debts, and money owed to the government for tax generally carry a 30-year prescription period.

How to Check If Your Debt Has Prescribed

Start by requesting a copy of your credit report from one of South Africa’s registered credit bureaus. Under rules enforced by the National Credit Regulator, you are entitled to one free credit report a year. Look at the date of your last payment or last contact from the creditor on each account. If it has been three years or more since that last payment or acknowledgement, with no legal action taken against you in that time, the debt is likely prescribed.

The Warning: Do Not Acknowledge or Pay Anything

This is the part people get wrong most often. If you acknowledge a debt in any way, verbally, in writing, by signing a new agreement, or by making even a small or partial payment, the three-year clock resets and starts again from that date. Debt collectors sometimes call about very old accounts specifically hoping you will confirm the debt is yours or agree to “just pay something small.”

Before you say anything or make any payment on an old account, check how long it has been since you last engaged with that creditor.

What If a Prescribed Debt Still Shows on Your Credit Report?

Prescription makes a debt legally unenforceable, but it does not automatically disappear from your credit profile. You may need to take formal steps to have it removed, including disputing it with the credit bureau or getting legal assistance to confirm its prescribed status in writing.
