Who Qualifies for an Administration Order?
Administration orders are aimed at consumers with smaller amounts of debt, typically under R50,000, who are still struggling to manage monthly repayments. To qualify, you apply to your local Magistrate’s Court and provide a full breakdown of your income, expenses, and debts.
An administrator, usually a legal professional or payment distribution agency, then consolidates your debts into a single monthly payment and distributes it to your creditors.
This route offers legal protection from further action, but it can take longer to clear than other options and remains on your credit profile until every debt is settled in full.
Who Qualifies for Sequestration?
Sequestration, sometimes called voluntary surrender, is generally treated as a last resort. It is available to consumers whose liabilities far exceed their assets, and the court needs to be satisfied that liquidating your estate will benefit your creditors, usually meaning your assets must cover at least a set percentage of your total debt.
You will lose control of major assets such as your home or vehicle, and the process can remain on your credit record for several years.

Can Prescribed Debt Qualify as Relief?
